Anyone caught growing will be arrested and charged under either the possession or intent to distribute laws currently in place. While possession of up to fifty pounds of cannabis may be punished by a year in jail under possession laws, if the state believes you were growing with the intent to supply, the same amount of cannabis could get you five years in jail.

While it is virtually impossible to grow a plant weighing under ten grams, the decriminalized amount, growing only a few plants will seldom raise suspicion. However, the more cannabis plants you are growing, the greater the chances are that the state will charge you with intent to supply, rather than the lesser charge of possession.
